Terms and Conditions

1. General

1.1 In these General Terms and Conditions, ‘Think Volunteer’ is understood to mean an organization that advises, informs, mediates and accompanies the conclusion of agreements between the traveler and Think Volunteer.

1.2 These conditions apply to all trips, volunteer programs and other services offered by Think Volunteer. Services means all activities that Think Volunteer (and cooperating partner organizations) performs within the framework of (the realization of) the agreement.

1.3 Traveler’s, volunteers, trainees of the services offered by Think Volunteer are referred to in these general terms and conditions as travelers.

1.4 By signing the registration form, the quotation, or when entering into the contract, the traveler states that he / she is aware of and agrees with these General Terms and Conditions.

2. Establish agreement
2.1 An agreement is concluded between Think Volunteer and the traveler as soon as Think Volunteer has assessed the application and confirmed it in writing. When the traveler submits the registration form, the traveler confirms that he / she has read and understood the general terms and conditions and agrees thereto.

2.2 Think Volunteer has the right to refuse a registration if, according to Think Volunteer, there is a valid reason for this. A good reason is mentioned if, in the opinion of Think Volunteer, the conditions for participation and / or the program requirements are not met.

2.3 The traveler is responsible for registering the correct dates. Adjustments and changes can be made by email. Any costs already incurred will be charged to the traveler.

2.4 There are minimum ages bound to the Think Volunteer programs. The age for the school trip is from 15 years. The age for the voyage of discovery is from 16 years and the age for volunteer work or internship is from 18 years.

2.5 As soon as the traveler has completed his / her online booking and the payment has been made, the booking is considered definitive by Think Volunteer.

3. Payment

3.1 When Think Volunteer agrees to the registration, an invoice is sent. Payment must be made within 14 days of the invoice date. After the expiry of 14 days after the invoice date, the traveler is in default without notice of default and by operation of law.

3.2 In the event of overdue payment, Think Volunteer is entitled to compensation for extrajudicial costs. These extrajudicial costs are determined on at least 15% of the outstanding invoice amount including VAT, with a minimum of € 150.00.

3.3. All judicial or extrajudicial costs to be incurred will then be charged to the traveler.

4. Change or dissolution agreement by Think Volunteer

4.1 Think Volunteer has the right to cancel the agreement with immediate effect if the number of registrations is less than the required minimum number. The minimum number for voyages of discovery / school trips is 10 travelers. The minimum number for trainees / volunteers is 5 passengers per workshop.

4.2 Think Volunteer has the right to terminate the agreement due to compelling circumstances. In any case (if not exclusively) there are serious circumstances if a negative travel advice applies to the area where the journey is to take place, in the event that the behavior of the traveler is of such a nature that the travel group is severely affected by this as well. if passengers endanger themselves and / or fellow travelers and / or partners of Think Volunteer and / or Think Volunteer.

4.3 If the traveler violates rules or shows serious misconduct, further participation in the trip may be denied. The full responsibility for all consequences that exclusion from further participation in the trip entails is for the account of the traveler concerned.

4.4 If the cause of the cancellation is attributable to the fact that there are too few registrations or are due to the fault of the traveler, the traveler is entitled to receive back all of his or her paid costs after deduction of actually by Think Volunteer. If the cause of cancellation is attributable to the traveler, the resulting damage will be borne by the traveler. If the cause of the cancellation is not attributable to Think Volunteer or the traveler, then the parties each bear their own damage. This is at the discretion of Think Volunteer.

4.5 If the traveler has provided incorrect and / or incomplete information to Think Volunteer, Think Volunteer is entitled at all times to (partially) dissolve the agreement with the traveler. In this case, the traveler is not entitled to a refund of the travel sum.

5. Cancellation of contract by the traveler

5.1 If the traveler cancels the contract, Think Volunteer will charge the traveler the following cancellation costs in addition to any booking fees due:

6. Travel documents

6.1 The traveler must be in possession of the necessary documents at departure and during the stay:
• The passenger must be in possession of a valid passport and ensure that this passport is valid for at least six months after the scheduled return date.
• If a visa is necessary for participation in the program, Think Volunteer can assist the traveler in applying for a visa. The costs, application and obtaining the required visa remain the responsibility of the traveler.
• Every traveler is obliged to take out travel insurance. The traveler must ensure that he is sufficiently insured against traveling expenses, medical costs and cancellation for the entire period of the stay. A cancellation insurance is highly recommended. The costs of insurance are borne by the traveler.
• The traveler must ensure that he / she has the correct travel documents. When a traveler is denied access to a country by incomplete, missing or incorrect documents, Think Volunteer cannot be held liable for any consequences and / or damage.
• When the passenger is responsible for the flight ticket, when booking the flight ticket, the arrival and departure day as described in the project information must be taken into account. Should the arrival and / or departure of the air ticket fall outside the requested day or the requested time, the traveler must arrange the transfer himself and pay the transfer costs.

6.2 When Think Volunteer has received the entire payment for the voyage of discovery, the travel documents will be sent by e-mail about two weeks before departure. Here the traveler will find all information concerning the journey. The traveler must check the details on the tickets and vouchers for accuracy. If something does not match what the traveler has booked, he or she should contact (preferably by e-mail) with Think Volunteer as soon as possible.

6.3 Think Volunteer requires personal details for booking a trip. This information is carefully handled by Think Volunteer and not provided to third parties.

7. Liability

7.1 The liability of Think Volunteer or of third parties hired by Think Volunteer to execute the agreement is limited to the program costs. The program costs are understood to mean what has been charged to the traveler by Think Volunteer. Other costs incurred by the participant are outside the definition of the program costs.

7.2 It is the traveler’s responsibility to obtain medical advice concerning vaccinations and medicines for the travel destination and to follow this up. The same applies to the possession of a valid passport and the required visa for the destination. Think Volunteer accepts no liability whatsoever for not arranging these matters or not arranging them on time. When a traveler is denied access to a country by incomplete or incorrect documents, Think Volunteer cannot be held liable for any consequences. Information provided by Think Volunteer about these matters is given in good faith and to the best of our knowledge.

7.3 Think Volunteer makes it obligatory to take out appropriate insurance before commencement of the journey. All damage and costs arising from not or insufficiently insured are for the account of the participant. Think Volunteer cannot be held responsible for this.

7.4 Think Volunteer is not liable for injuries sustained by the traveler’s own actions. Participation in the program and the associated activities is at your own risk.

7.5 Think Volunteer is not liable for consequential damage, property damage, immaterial damage and (other) indirect damage, caused by any cause, unless there is gross recklessness or intent of Think Volunteer.
7.6 Think Volunteer is not liable for damage of whatever nature, caused by Think Volunteer assumed incorrect and / or incomplete information provided by the traveler, unless this incorrectness or incompleteness for Think Volunteer was or should have been known.

7.7 All cases in which Think Volunteer is obliged to pay compensation will never exceed the costs paid by the participant in Think Volunteer. If the participant is eligible for a refund of any amount, Think Volunteer can set off a fee for services that the participant has enjoyed. Costs include, but are not limited to, administration costs, program costs, costs for airline tickets and a reasonable amount for other services already enjoyed and / or performed by Think Volunteer and / or the partner organization.

7.8 The legal rules also apply to liability.

8. During the journey

8.1 Think Volunteer will take care of a good contractor during the execution of the agreement.

8.2 The traveler is aware that traveling and staying in developing countries entails risks and that facilities, including medical, are in many cases of lesser quality than in the Netherlands. Travelers are advised to familiarize themselves with generally accepted precautionary measures against health risks in the country of destination. No liability is accepted by Think Volunteer for loss, injury or death. An appropriate travel insurance is mandatory.

8.3 The traveler will stay in an accommodation approved by us. During the voyage of discovery, the travelers stay in a hostel. If the number of passengers is too large, the group will be divided between two hostels. In the case of volunteer work or work experience, the traveler stays in a house with possibly several housemates.

8.4 Based on the flight times to Jakarta, it is determined whether the same day will be flown to Yogyakarta or the day.

8.5 The traveler is aware that it is not self-evident that guidance from Think Volunteer flies to Yogyakarta. The traveler can assume that he / she is being taken care of by a representative of Think Volunteer in Indonesia.

8.6 The traveler must take into account that the flight to Indonesia can depart from Amsterdam, Brussels, Düsseldorf or Cologne.

8.7 The 5-day workshop for volunteers and trainees is a compulsory part of the program.

8.8 The traveler must adhere to the code of conduct of Think Volunteer. If the traveler violates rules or shows serious misconduct, further participation in the trip may be denied. The full responsibility for all consequences that exclusion from further participation in the trip entails is for the account of the traveler concerned.

9. Complaints
9.1 Should a traveler have complaints and about the trip or the accommodation, this should immediately be reported to the representative of Think Volunteer on site, so that Think Volunteer gets the opportunity to resolve the complaint. On the spot, Think Volunteer will do its utmost to handle the complaint properly and find a suitable solution. After this, the complaint can no longer be returned.

10. Final provisions

10.1 All disputes between Think Volunteer and the travelers will exclusively be judged by the competent court in the district of Almelo. Contrary to this, Think Volunteer is entitled to apply to the court of the participant’s place of residence.

10.2 All agreements concluded by Think Volunteer are governed exclusively by Dutch law.
